Terms and Conditions of Service
THE ULTIMATE TRANSPORTER LLC

Welcome to The Ultimate Transporter. These Terms and Conditions ("Agreement") govern your use of our final mile delivery services, including our website, mobile applications, and all related services (collectively, the “Services”).

By using our Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

1. Services Provided

We provide final mile delivery and logistics solutions for individuals and businesses, including scheduled and on-demand deliveries. The specific scope and cost of Services will be outlined in your service order or agreement.

2. User Eligibility

You must be at least 18 years old to use our Services. By using our Services, you represent and warrant that you meet this requirement and have the legal authority to enter into this Agreement.

3. Account Registration

Some features may require you to register an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.


4. Delivery Terms

  • a. Scheduling and Access
    Customers must ensure accurate delivery information and that someone is available to receive the delivery. Failure to do so may result in delays, additional charges, or return of goods.


  • b. Delivery Restrictions
    We reserve the right to refuse, cancel, or return items deemed unsafe, illegal, or improperly packaged.


  • c. Delays and Liability
    While we strive for timely delivery, we are not liable for delays caused by weather, traffic, or other unforeseen events beyond our control.


5. Fees and Payment

All fees are outlined prior to confirmation of the delivery. Payments must be made through approved methods. Failure to pay may result in suspension of Services and/or late fees.


6. Cancellations and Refunds

Cancellations made more than 24 hours in advance will be refunded in full. Late cancellations or no-shows may be subject to a cancellation fee. Refunds for incomplete deliveries are handled on a case-by-case basis.


7. Limitation of Liability

To the fullest extent permitted by law, The Ultimate Transporter shall not be liable for any indirect, incidental, special, or consequential damages, including but not limited to loss of profits or data, even if we have been advised of the possibility of such damages.


8. Insurance and Damage Claims

We may offer limited insurance for damaged or lost items in transit. Claims must be submitted within [insert number of days, e.g., 7 days] of delivery with supporting documentation.


9. Prohibited Use

You agree not to use the Services for:

  • Transporting illegal or hazardous materials
  • Abusing or harassing our staff or drivers
  • Tampering with or misrepresenting packages
  • Violating applicable laws or regulations


10. Intellectual Property

All content, branding, software, and materials provided through the Services are owned or licensed by The Ultimate Transporter and protected by intellectual property laws. You may not use our content without written permission.


11. Privacy Policy

Your use of our Services is also governed by our Privacy Policy, which outlines how we collect, use, and protect your information.

12. Governing Law

This Agreement is governed by the laws of the State of Arizona, without regard to its conflict of law principles. Any disputes shall be resolved in the courts located in Pima County, Tucson, AZ.

13. Changes to Terms

We may update these Terms from time to time. Continued use of the Services after such changes constitutes your acceptance of the revised Terms. We encourage you to review this page periodically.

Return and Refund Policy

At The Ultimate Transporter, customer satisfaction and delivery accuracy are our top priorities. This Return and Refund Policy outlines how we handle cancellations, failed deliveries, return shipments, and refund requests for our final mile delivery services.


1. Cancellations

Customer-Initiated Cancellations:

  • Orders canceled more than 24 hours prior to the scheduled delivery time are eligible for a full refund.
  • Cancellations made less than 24 hours in advance may be subject to a cancellation fee.


Company-Initiated Cancellations:

  • If we are unable to complete a scheduled delivery due to operational issues or unforeseen circumstances, you will be notified promptly and a full refund will be issued.

2. Failed Deliveries

Deliveries may be considered "failed" under the following circumstances:

  • The recipient is unavailable at the delivery location
  • Incorrect or incomplete address provided
  • Lack of required access (e.g., building access, gate code, etc.)

In such cases:

  • We may attempt redelivery, subject to an additional fee
  • If redelivery is declined, you may request a return of the item(s), also subject to additional charges
  • Refunds are not guaranteed for failed deliveries unless the failure was due to our error


3. Returns

If a package must be returned to the sender:

  • Return fees may apply depending on distance, size, and time involved
  • Return deliveries must comply with our delivery and safety standards
  • All return requests must be initiated within 7 days of the original delivery attempt


4. Damaged or Lost Items

If an item is damaged or lost during delivery:

  • Claims must be filed within 3–7 days of the delivery date
  • Proof of damage or value may be required (photos, receipts, etc.)
  • Compensation will be based on our standard coverage, unless additional insurance was purchased


5. Refund Process

Approved refunds will be processed using the original payment method within 5–10 business days.

6. Non-Refundable Services

Refunds will not be issued for:

  • Deliveries completed successfully
  • Services where the delay or issue was caused by customer action or inaction
  • Unauthorized returns or complaints made beyond the specified timeframes


7. Policy Updates

We reserve the right to update this Return and Refund Policy at any time. The updated version will be posted on our website with the revised effective date.
